On Monday, the Delhi High Court announced that accepting the new privacy policy on WhatsApp was voluntary. According to the company, you should not choose to use or join that platform if you did not agree with its terms and conditions.
According to a lawyer, who has challenged WhatsApp’s new privacy policy, Justice Sanjeev Sachdeva, it is a private app, and people should not join and accept it. Instead, they should use another app. Significantly, the privacy policy should have come into effect in February but has seen a delay till May.
Furthermore, the court announced that if you read most mobile apps’ T&C, you would be surprised as to what all you agree to. Court added that even Google maps captures all data and stores it.
Additionally, the court reported that it could not understand what data could leak, according to the petitioner. Since the issue needs consideration, it will list on January 25 due to lack of time on Monday.
Notably, the central government also agreed with the court that the issue needs to be analyzed.
Additionally, Kapil Sibal and Mukul Rohatgi, senior advocated represented WhatsApp and Facebook. They informed the court that the plea was not maintainable.
They also told the court that private chat messages among family and friends would remain encrypted. WhatsApp can not save it. This would not change under the new policy.
They announced that the policy change would only touch the business chats on WhatsApp.
Furthermore, by a lawyer, the petition has contended that the updated privacy policy disrupts users’ right to privacy under the Constitution.
The petition has also claimed that WhatsApp’s new privacy policy provides full access to a customer’s online activity without government supervision.
Significantly, users can either accept the new policy or exit the app. However, they cannot choose not to share their data with other Facebook-owned apps.
Another essential thing to mention is that the lawyer appearing for the petitioner made an allegation that the option not to agree with the new policy was given to customers in European nations, but not in India.
